Impact Early Years – Terms and Conditions

Welcome to Impact Early Years. These Terms and Conditions (“Terms”) govern your access to and use of the Impact Early Years platform (“Platform”), provided by Jigsaw Early Years Consultancy Ltd (“we”, “us”, or “our”).
By creating an account, subscribing, or using our Platform, you agree to be bound by these Terms.
1. Eligibility and Account Access
– The Platform is intended for use only by registered Early Years Providers in the UK.
– Only organisations can create a subscription; individual staff accounts are managed under the organisation’s licence.
– You are responsible for maintaining the confidentiality of your login credentials.
2. Platform Purpose
Impact Early Years is a web-based tool designed to help Early Years Settings meet compliance requirements by focusing on:
– Compliance
– Staffing
– Safeguarding
The Platform allows for the secure storage and management of staff, child, and parent data to support these functions.
3. Subscription and Payment
– Subscriptions are available on a monthly or annual basis and are billed via Stripe.
– You will be charged automatically at the beginning of each billing period unless you cancel in advance.
– A 14-day cooling-off period is available from the date of your initial subscription. After this period, no refunds will be issued.
– Failure to pay may result in account suspension or termination.
4. Licensing
– Each subscription grants a single licence for use by one Early Years setting.
– If your organisation operates multiple settings, you must purchase a separate subscription for each setting.
5. Data Protection and Security
– The Platform stores personal data of staff, children, and parents. All data is handled in compliance with UK GDPR and the Data Protection Act 2018.
– Data is hosted securely on Amazon Web Services (AWS) and our servers run through Digital Ocean.
– We use ARM Systems’ third-party developers to support and maintain the platform under strict confidentiality agreements.
– You are responsible for ensuring that your use of the platform complies with all data protection requirements in your setting, including obtaining any necessary consents.
6. Security Breach Notification
– In the event of a data breach, we are committed to full transparency.
– We will notify all affected parties as soon as reasonably possible, providing relevant details of the incident and recommended steps.
– We will take immediate measures to investigate and resolve the issue to minimise any impact.
7. User Responsibilities
– You must ensure that data input into the Platform is accurate and lawful.
– You agree not to misuse the Platform, including attempting to gain unauthorised access or introducing malicious code.
– You must inform us immediately if you suspect a security breach or data compromise.
8. Support and Maintenance
– We provide technical support via email, phone, or contact form during normal business hours.
– We may carry out planned maintenance from time to time and will endeavour to notify users in advance.
9. User Registration
– All users must provide accurate and complete information during registration.
– You are responsible for updating your information to keep it accurate and current.
10. Account Deletion and Data Retention
– If you request to delete your account, your data will be securely retained for a period of 12 months from the date of deletion request.
– It is your responsibility to ensure you have downloaded and stored any necessary documents before your account is deleted.
– After 12 months, all data will be permanently deleted and cannot be recovered.
11. Intellectual Property
– All content, features, and functionality of the Platform are the intellectual property of Jigsaw Early Years Consultancy Ltd or its licensors.
– Users are strictly prohibited from copying, downloading, sharing (except as specifically permitted), modifying, translating, adapting, publishing, transmitting, selling, sublicensing, editing, transferring, or assigning any content from the Platform to third parties, or creating derivative works from it.
– Users must not enable or allow any third party to do so through their account or device, whether knowingly or unknowingly.
– All trademarks, trade names, service marks, illustrations, images, and graphics displayed on this Platform are the exclusive property of Jigsaw Early Years Consultancy Ltd or its licensors and protected by applicable intellectual property laws and international treaties.
12. Prohibited Behaviours
You may not:
– Attempt to gain unauthorised access to the Platform or other accounts.
– Use the Platform in a manner that is illegal, fraudulent, or harmful.
– Upload viruses or malicious code.
– Resell, rent, or lease the Platform to others.
– Infringe upon the intellectual property rights of the Platform or third parties.
13. End-User Licence Agreement (EULA)
– This Platform is licensed, not sold.
– The licence is non-transferable, non-exclusive, and revocable.
– You are granted access solely for internal business use within your setting.
14. Corrections
– We reserve the right to correct errors, inaccuracies, or omissions at any time without prior notice.
– We are not obligated to update any information unless required by law.
15. Termination
– You may cancel your subscription at any time, but no refunds will be provided after the 14-day cooling-off period.
– We reserve the right to suspend or terminate access for any breach of these Terms.
16. Limitation of Liability
To the fullest extent permitted by law, we and our affiliates, officers, directors, agents, partners, suppliers, and employees shall not be held liable for:
– Indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, goodwill, data, use, or other intangible losses.
– Loss or damage resulting from unauthorised access, hacking, tampering, or misuse of the Platform or accounts.
– Errors or omissions in content provided through the Platform.
– Personal injury or property damage resulting from use of the Platform.
– Interruptions or discontinuation of service.
– Malicious software that may be transmitted through the Platform.
– Content shared or made available through the Platform by users or third parties.
– Offensive, illegal, or defamatory conduct by any user or third party.
17. Changes to These Terms
– We reserve the right to update these Terms. You will be notified of significant changes by email or through the Platform.
– Continued use of the Platform after changes constitutes your acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the English courts.
19. Disputes
– In the event of a dispute, we encourage you to contact us directly to resolve the matter informally.
– If a resolution cannot be reached, disputes shall be resolved in accordance with the laws and courts of England and Wales.
20. Cookies
– Our Platform uses cookies and similar technologies. A pop-up message will inform you of this on your first visit.
– By continuing to use the Platform, you consent to our use of cookies as outlined in our Cookie Policy.
21. International Data Transfers
– The Platform is intended for use in the UK only. Any access from outside the UK is at your own risk.
– If you choose to access the Platform from outside the UK, you are responsible for compliance with local laws.
